DEFENSE OF BID PROTEST BY SECOND LOW BIDDER

The firm’s client was the lowest responsive bidder on a $13 million dollar public works project.  The second low bidder protested, alleging the client’s listed DVBE subcontractor would not be performing a commercially useful function as required by California law.  The firm successfully defended the client before the California Department of General Services.  After trial on the briefs, the Department of General Services denied the protest in full and allowed award of the contract to the firm’s client.
